Immigration Holds / Ice Holds

Hey everybody! Houston criminal defense attorney Eric Benavides here.

Today, I wanted to talk to you a bit about immigration holds or ice holds. Ice holds are basically federal holds that are placed on individuals that are in county jails that indicate to the county and to everybody that immigration is going to start a deportation proceeding against that individual.

Now, the effect of an immigration hold or an Ice hold on somebody in custody is that they cannot bond out, there’s a hold on them to detain them for immigration and to eventually transfer them.

Once a bond is placed or once the case is over they’ll get transferred to immigration, at which point, deportation proceedings will commence. There is no way to remove these holds unless the federal government does it. It’s just something we have to deal with the workaround.
